Once we received the Plea we can then, in terms of the Court rules, start the 3 step-process to obtain a court date/ trial date to finalise your claim which includes the following 3 steps:

  • We must arrange all necessary medio legal assessments that you need to attend to enable us to obtain the medico legal reports/ expert reports necessary to prove your claim.  We must then wait to receive all of these medico legal reports/ expert reports back from our experts before we can proceed to the next step.
  • Thereafter, we can request a date for the first pre-trial meeting with the RAF Attorneys.
  • Once the first pre-trial meeting with the RAF Attorneys are finalised, we can then request a date for a second pre-trial meeting with the RAF Attorneys and the Judge, where we will request the Judge to certify your case as ready for court.  Should the Judge do this, we will obtain a court date.”

It is important to understand that the actual court date/ trial date may only be a year or more after we apply for the court date/ trial date due to the unavailability of earlier trial dates.

In other words, the court dates/ trial dates are usually pre-booked for more than a year in advance in the High Court.  For example, if an application for a court date/ trial date is lodged on 16 March 2020 then the actual trial date may only be on 16 March 2021.

For this reason, we do everything in our power to keep the pressure on the Road Accident Fund and their attorneys to ensure that cases are not delayed unnecessarily.

Our supporting staff will arrange medico legal appointments on your behalf and will make sure that appointments are timeously attended, clients are booked into guesthouses where necessary and the appropriate travelling arrangements are made for medico legal assessments outside of Welkom.

Our professional team will also do the necessary to properly prepare your case for court by attending inspections of the scene of the accident, interviewing witnesses, investigating and obtaining the necessary documentary evidence to support your case, consulting with clients, experts and Advocates to ensure that we are fully prepared and ready to go on trial and to prove your case in court on both the merits and the quantum.
